These terms of Service (‘‘Terms’’) govern your use of AdviceRush website (referred to as ‘‘Technology Platform’’, provided and operated by AdviceRush Ltd (or referred to as ‘‘AdviceRush’’, ‘‘we’’, ‘‘us’’, ‘‘our’’). By using this Technology Platform within any country in the world, you agree to be bound by these Terms. You must not use this Technology Platform if you do not agree with these Terms. AdviceRush aims to continuously modify and improve the Technology Platform by changing, adding or removing any features and therefore may amend these Terms accordingly. Any amended Terms shall prevail over these Terms in the event of a conflict. You must be 18 years of age or more to use this Technology Platform. If you are using AdviceRush on behalf of a business, you warrant that you have the necessary authority to bind that business as well as yourself to these Terms. AdviceRush’s failure to monitor or enforce any of these Terms does not constitute a waiver of its right to do so at any point in time with respect to any of these Terms. AdviceRush is a technology company which helps customers get affordable advice by connecting them to a pool of qualified partner advisers through a technology platform. You acknowledge and agree that AdviceRush does not form any employment, agency or contractual relationship with you. The Advisers are independent service providers and are not employees or agents of AdviceRush and therefore, together with the customers, are simply users of the Platform. Advisers determine which questions to answer by themselves. You also agree that by using this Technology Platform, you will respect those who you come in contact with including Advisers and AdviceRush customer services staff or any other staff member of AdviceRush. AdviceRush does not guarantee the quality or suitability of advice by Advisers and therefore any risk resulting from the use of Advisers or their advice remains solely with you. You also agree that to the maximum extent permitted by applicable law, neither AdviceRush nor its affiliates will be liable for any claim, injury, death or damage resulting from the use of Advisers. If you incur a loss of any kind (financial or non-financial) due to use of partner Advisers, you agree to release AdviceRush (including AdviceRush’s affiliates and each of their respective officers, directors, employees, agents, shareholders) from any claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, resulting directly or indirectly from such loss. Adviser’s communication with you through our Technology Platform or phone or email conversation may contain typo errors, inaccuracies or omissions. In such and all circumstances, neither AdviceRush nor its affiliates will be responsible or liable for any loss, injury, damage, death or claim arising and you agree to take full responsibility and to pay the associated charges in full.

Technology Platform Availability

AdviceRush Technology Platform connects you ‘’the Customers’’ with the AdviceRush partner advisers ‘‘the Advisers’’ for you to seek advice from the Advisers. Subject to your compliance to these Terms, AdviceRush grants you a limited, non-transferrable licence to access the Technology Platform on your personal device and access and use any material made available through the Technology Platform. Any rights not expressly granted herein are reserved by AdviceRush and AdviceRush’s licensors. The Advisers each decide their own operating hours that means that the service depends on the availability of the Advisers. If you try to seek an advice outside the operating hours of Advisers or the Technology Platform is otherwise unavailable for any reason, we will notify you that use of Technology Platform is not possible. You are responsible for obtaining the data network access necessary to use the Technology Platform. Your mobile network’s data and messaging rates and fees may apply if you access or use the Technology Platform from a wireless-enabled device and you shall be responsible for such rates and fees.

Your Account

You will need to register for an AdviceRush account for you to use our Technology Platform for which, we’ll ask you to provide your personal information including an email address, a mobile phone number, your address and a unique password, all of which remains hidden from the Advisers and not shared with them unless you hire them separately on ad hoc or full time basis. Your username which you choose at the time of creating your user account is shared with the Advisers in order to have your answers delivered to you. Depending on which payment method you opt for, you may need to provide us with your credit or debit card details. You accept that all advice requests made under your AdviceRush account are your sole responsibility. If another person uses your account, you will be responsible for any requests they make and the charges associated with it and we are not responsible for any losses you suffer. We may also suspend or close your account if we believe that your account has been used by someone else. We may also suspend or close your account or close it permanently if in our opinion you are abusing our Technology Platform (for example, by applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating our staff or any other reason). If we close your account permanently, we will refund any remaining account credit you have validly obtained from our customer services team by applying a credit to your registered credit card, or if that is not possible for any reason, by way of a bank transfer using bank details (you have supplied them to us) or any other reasonable payment method. You may not create another account on our Platform nor assign or otherwise transfer your account to any other person or entity. You agree to comply with all the applicable laws when using the Technology Platform and do not cause nuisance, annoyance, inconvenience or carry out any illegal activity.

Questions and Answers

A question is successfully posted when you receive a notification ‘‘Question Posted’’. The posted questions are not sent to the advisers until the customers have paid in advance to receive their answers. Advisers may ask you for more information before they can answer your questions. Customers shall expect to receive answer to their question within 24 hours excluding weekends and bank holidays. AdviceRush does not take any responsibility if Customers do not receive answer to their question within 24 hours due to any reason whatsoever and/or any resulting loss of any kind. Emergency questions should not be directed to this Platform, instead be directed to the relevant professional (s) through phone or in person. You understand and acknowledge that answers provided through this Platform are for information purposes only and do not substitute the in person evaluation or specific professional advice. You also understand and acknowledge that AdviceRush does not edit, modify, endorse or guarantee the content of the questions and/ or answers. AdviceRush platform and its content should also not be used for the purposes of plagiarism in any context or in cheating in the academic setting. When submitting any question including follow up and subsequent questions, please don’t reveal personal details, such as private addresses, phone numbers, email addresses or other online contact details.

Cancellation and Refund Policy

The posted questions are not sent to the advisers until the customers have paid in advance to receive their answers. Once the payment has been made, the customers are not able to cancel a posted question and will be charged the full fee. If you need to cancel a question after it has been posted and paid but before you receive an answer, then please contact our support team at support@advicerush.com. AdviceRush may process refunds in its sole discretion taking into account whether the question has been answered or not. If you contact us to cancel your posted question on 3 different occasions, then AdviceRush reserves the right to suspend or terminate your AdviceRush account in its sole discretion and without your permission. AdviceRush reserves the right to cancel any posted question and suspend, deactivate or terminate your AdviceRush account in its sole discretion if it reasonably suspects or detects any fraudulent behaviour or activity associated with your AdviceRush account and/or with your posted question. AdviceRush expects customers to submit only the legitimate questions through our Platform. AdviceRush may cancel your posted question due to unforeseen circumstances. If this happens, we will notify you and you will not be charged for any posted question cancelled by AdviceRush.

Prices and Payments

Posting a question on AdviceRush platform is absolutely FREE. We even offer one follow up question (if needed) answered absolutely FREE. Customers are able to see the price after posting a question but only pay if they want to receive an answer. AdviceRush reserves the right to change the prices at any time without any notice to its customers. VAT is charged at the standard rate and is included in the price. There is no charge for one follow up question provided it is asked within 24 hours of the answer to the first question. Any subsequent questions will be charged at the full price.

User Content

All the questions and the answers posted including any feedback requested and offered by customers via AdviceRush Technology Platform is user content ‘‘User Content’’. By providing User Content, you grant AdviceRush a worldwide, perpetual, irrevocable, transferrable, royalty-free licence, with the right to sublicense to use, copy, modify, create derivate works of, distribute, publicly display, publicly perform and otherwise exploit in any manner using any media such User Content, without further notice to or consent from you and without any payment to you or any other person or entity. You confirm that all such User Content is your property and AdviceRush’s use of such content will not infringe, misappropriate or violate a third party’s intellectual rights or result in the violation of any applicable law. You agree to not provide or upload User Content that is false, inaccurate, misleading, defamatory, libellous, hateful, violent, obscene, pornographic, unlawful or otherwise offensive or contains any computer viruses, worms or other potentially damaging computer programs or files. AdviceRush may, but shall not be obligated to, review, monitor or remove such User Content at any time and without any notice to the Users and take appropriate and legal action permitted under the applicable law. We encourage comments on AdviceRush related subjects in an intelligent and constructive manner. Treat others as you would like to be treated. Be polite, even if you disagree. Any communication through our Platform is not pre-moderated. Abusive language, aggression and bullying are not allowed in any way or shape directed to anyone involved in providing our services, AdviceRush retains the right to remove any content posted on Technology Platforms and social media or block users from posting to any AdviceRush page for any other reason than that deemed necessary to create a helpful community.

Intellectual Property

All trademarks, logos, images including these Terms as displayed on the Technology Platform or in our marketing material, whether registered or un registered, are the intellectual property of AdviceRush and or third parties who have authorised us with the use (collectively the ‘‘Trademarks’’). You may not use, copy, reproduce, republish, upload, post, transmit, distribute or modify these Trademarks in any way without our written consent. The use of AdviceRush’s trademarks on any other Technology Platform not approved by us is strictly prohibited. AdviceRush will aggressively enforce its intellectual property rights to the fullest extent of law. AdviceRush neither warrants nor represents that your use of materials displayed on the Technology Platform will not infringe rights of third parties not owned by or affiliated with AdviceRush. Use of any materials on the Technology Platform is at your own risk.

Data Protection

You agree and consent to AdviceRush and any of its affiliate companies collecting, using, processing and disclosing your personal data in accordance with these Terms and the applicable law. When you register to use the Technology Platform, you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities that occur or are submitted under your password. If AdviceRush has a reason to believe that there is likely to be a breach of security or misuse of our Technology Platform, we may require you to change your password or we may suspend your account. Please refer to our Privacy Policy on our Platforms for further information on how we process your data.

Representations, Warranties and Liabilities

You acknowledge and agree that the content on the Technology Platform is provided on ‘‘as is’’ and ‘‘as available’’ basis and that your use of or reliance upon the Technology Platform and any content, items or services accessed or obtained thereby is at your sole risk and discretion. While AdviceRush makes reasonable efforts to ensure the provision of the Technology Platform and the services we offer, are available at all times, we do not warrant or represent that the Technology Platform shall be provided in a manner which is secure, timely, uninterrupted, error free, free of technical difficulties, defects or viruses. Please accept temporary interruptions of the Technology Platform due to scheduled or regular system maintenance work.

Limitation of Liability

To the extent permitted by law, AdviceRush (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) from any and all claims, demands, losses, liabilities and expenses which you or any third party may incur in connection with our Technology Platform and services or any content or material posted on it. The AdviceRush and all its affiliates shall not be liable for any direct, indirect, special, incidental, punitive or consequential and exemplary damages, even if AdviceRush has been advised of the possibility of such damages, arising from your use of the Technology Platform or for any claim in anyway related to your use of the Technology Platform. The material on this Technology Platform may include the views or recommendations of third parties, which do not necessarily reflect the views of AdviceRush or indicate its commitment to a particular course of action. We assume no responsibility or liability arising in respect of any such third party material. We assume no responsibility if the answer to your question is not delivered within 24 hours of you asking that question (s) due to any reason whatsoever and any loss whatsoever resulting from it.
